We have closed our doors due to upcoming regulatory concerns that affect all US-based medical clinics.

The current regulatory landscape is complex and we, at Peak, wanted to prioritize patient safety to provide ample time for our patients to find alternative care.

With regards to regulations, the Federal Public Health Emergency is set to end on January 11, 2023. The PHE waives the Ryan Haight Act, which enables providers to help patients over telemedicine and grant prescriptions for controlled substances, such as ketamine, without the need for in-person appointments. There is a chance that the PHE will be extended for another 90 days, however, we currently do not believe it would be extended any further than that, given that the Biden Administration has claimed the pandemic is over.

We have been hopeful that Congress would extend all the benefits of telemedicine. While the House of Representatives passed HR 4040 with overwhelming bipartisanship to extend many of the benefits of telemedicine, the Ryan Haight Act waiver, allowing us to continue helping patients over telemedicine, was omitted. The bill now goes to the Senate, however, we do not believe Congress will append the bill in time for us to continue to serve patients.

This was a difficult decision for us to make. Clinical safety is our top priority and instead of holding out until the very last minute, we wanted to ensure patients have a safe transition period to titrate off medication or transfer to another clinic.
